These Terms and Conditions (“Terms”) govern your use of the Sestive Platform (“Platform”), provided by Sestive Inc. (“we,” “our,” or “us”). By accessing or using the Platform, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, you must refrain from using the Platform.
We are committed to providing a secure, efficient, and user-friendly platform for mental health professionals and their clients. These Terms apply to two types of users of the Sestive Platform:
- Therapists: Licensed psychotherapists, psychoanalysts, and other mental health professionals who use the platform to offer therapy services to clients.
- Clients: Individuals seeking therapy who use the platform to connect with therapists.
1. Acceptance of Terms
By accessing or using the Platform, you agree to these Terms, as well as our Privacy Policy, which is incorporated herein by reference. If you are accessing the Platform on behalf of an organization or entity, you represent and warrant that you have the authority to bind that organization to these Terms.
2. Eligibility
- For Therapists: You may use the Platform to offer therapy services to clients, but it is your responsibility to ensure that you are qualified and licensed to practice therapy in your jurisdiction. We do not verify the credentials or licensing of therapists.
- For Clients: You must be at least 18 years old (or the legal age of consent in your jurisdiction) to use the Platform, or have parental consent if underage. You are responsible for researching and verifying the qualifications, credentials, and licensing of any therapist you choose to engage with on the Platform.
3. Account Registration
To use the Platform, you must create an account. You agree to provide accurate, complete, and up-to-date information during the registration process and to update such information as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
- For Therapists: While we do not verify your professional qualifications, you are required to ensure that your practice complies with all applicable laws and regulations in your jurisdiction.
- For Clients: You must provide accurate contact and health-related information to ensure that your therapy sessions are properly scheduled and conducted.
4. Use of the Platform
- For Therapists: You may use the Platform to conduct therapy sessions, manage client appointments, access session data, and use additional tools for improving therapeutic practices. You agree to maintain confidentiality and privacy of all client data in accordance with applicable privacy laws (e.g., HIPAA, GDPR).
- For Clients: You may use the Platform to book and attend therapy sessions, access your personal data, and communicate with your therapist. You agree to provide accurate information during your sessions and engage in a respectful manner. Additionally, you are responsible for verifying that the therapist you choose meets your expectations and professional requirements.
5. Payment Terms
- For Therapists: The Platform charges a monthly subscription fee for the use of the Platform’s features and services. The fee is charged based on the plan selected during the registration process. The monthly fee is billed to the therapist’s account, and all payments are processed by Sestive for the use of the Platform only.
- For Clients: Payments for therapy sessions (such as per session fees or any other arrangement) are handled directly between you and your therapist. Sestive does not process, collect, or manage payments for therapy sessions. It is the responsibility of the therapist and the client to arrange and agree upon payment terms for individual sessions. Sestive does not handle or facilitate any financial transactions related to therapy sessions.
6. Intellectual Property
The Platform and all its content, including but not limited to text, graphics, logos, images, software, and other materials, are owned by Sestive or its licensors and are protected by intellectual property laws. You agree not to copy, modify, or distribute any content from the Platform without prior written permission from Sestive.
7. Termination
We reserve the right to suspend or terminate your access to the Platform at any time, without notice, for any breach of these Terms or for any conduct that we believe is detrimental to the Platform or its users.
- For Therapists: Your account may be suspended if you fail to maintain professional qualifications, violate privacy or confidentiality agreements, or otherwise fail to comply with applicable laws.
- For Clients: Your access may be suspended if you engage in harmful behavior or violate the Platform's usage guidelines.
8. Data Privacy and Confidentiality
We take privacy and confidentiality seriously. For detailed information about how your personal data is handled, please refer to our Privacy Policy.
- For Therapists: You are responsible for ensuring that all client data is treated confidentially and in compliance with HIPAA, GDPR, or any other applicable data protection laws.
- For Clients: You are responsible for providing accurate personal and health-related data to ensure the therapy process is effective and secure. You acknowledge that while we take reasonable measures to protect your data, no online platform is completely secure.
9. Prohibited Use
You agree not to use the Platform for any unlawful, harmful, or malicious purpose, including but not limited to:
- Distributing viruses, malware, or any other harmful software.
- Impersonating any person or entity or falsely stating or misrepresenting your affiliation with a person or entity.
- Engaging in harassment, abusive behavior, or any activity that could harm or disrupt the use of the Platform by others.
10. Disclaimers and Limitation of Liability
The Platform is provided "as is" without any warranties of any kind, either express or implied. We do not guarantee the accuracy, completeness, or availability of the Platform. You use the Platform at your own risk.
Sestive will not be liable for any indirect, incidental, special, or consequential damages, including but not limited to damages arising from lost data, loss of business, or harm caused during therapy sessions, except to the extent required by applicable law.
11. Indemnification
You agree to indemnify and hold harmless Sestive, its affiliates, employees, officers, and agents from any claims, damages, or liabilities arising from your use of the Platform, your violation of these Terms, or your breach of any applicable law or regulation.
12. Changes to the Terms
We reserve the right to modify or update these Terms at any time. Any changes will be communicated through the Platform. Continued use of the Platform after such changes will constitute your acceptance of the updated Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Notwithstanding the foregoing, if you are a resident or user in a jurisdiction where consumer protection laws require a different governing law, such laws will apply to your use of the Platform as required by local law.
14. Dispute Resolution
Any disputes arising from or related to these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA) or another mutually agreed-upon arbitration organization. The venue for arbitration shall be Wilmington, Delaware, unless otherwise required by applicable law in your jurisdiction. Notwithstanding the foregoing, nothing in this section prevents you from seeking interim or emergency relief in a court of competent jurisdiction.
